These terms and conditions govern the use of The Great British Bake Off app (“GBBO App”), a free app for iOS and android devices connected with The Great British Bake Off, The Great British Bake Off – An Extra Slice and other related programming (collectively the “Programme”). If these Terms and Conditions are not acceptable to you, then you should stop using the GBBO App immediately and delete it.

In these Terms and Conditions, “we/us/our/Love Productions” refers to Love Productions Limited of 43 Eagle Street, London WC1R 4AT (a company incorporated in England and Wales with registered number 5221898 of registered office Grant Way, Isleworth, Middlesex TW7 5QD) and its assignees, licensees and/or affiliates and, where appropriate, to the creators of and contributors to the construction of the GBBO App and its content (excluding user-generated content). “You/your/yourself” refers to any visitor to and user of the GBBO App and its content and, where appropriate, persons submitting material to the GBBO App, including for example photographs and/or recordings in any format (“Material”).

1. Introduction

1.1       By accessing and/or using the GBBO App (including by submitting any Material via the GBBO App), you have expressly consented to these Terms and Conditions.

1.2       These Terms and Conditions should be read in conjunction with the GBBO App Privacy Policy. All capitalized definitions used in the Privacy Policy shall, unless otherwise stated, have the same meaning as ascribed to such definitions under the Terms and Conditions.

1.3       We reserve the right to modify, update or otherwise change these Terms and Conditions (or any part of them) at any time without prior notice. Any changes will be published on this page and your continued use of the GBBO App will be considered to be acceptance of the changes. You are advised to check these terms and conditions regularly.

1.4       In addition to these Terms and Conditions, the terms and conditions for the distribution platform used to download the GBBO App (e.g. the Apple App Store, Google Play) shall also apply.

1.5       You must be 16 years of age or over to use the GBBO App.

2. Disclaimer

We cannot accept any responsibility for any damage, loss or injury suffered through use of the GBBO App unless due to the negligent act or omission of Love or any individual for whom it is legally responsible. The content of the GBBO App is for information purposes only and is not intended to be and does not constitute dietary advice or recommendations. You should always use your best judgment when cooking with raw ingredients such as eggs, chicken or fish and seek expert advice before beginning your recipe if you are unsure. You should always take care not to injure yourself or others on sharp knives or other cooking implements or to burn yourself or others while cooking. You should examine the contents of ingredients prior to preparation and consumption of these recipes in order to be fully aware of and to advise others accurately of the presence of substances which might provoke an adverse reaction in some consumers. Children should be supervised at all times when cooking.

3. Links

The GBBO App is available for download via various distribution platforms (e.g. Apple App Store, Google Play) and the GBBO App may may also be accessible from and/or contain links from sites or platforms operated by third parties. We are not responsible for the contents of any of those other websites and platforms (including any goods or services offered or supplied through such a website or platform) or any hyperlink contained in any linked websites or platforms. We encourage you to review the terms and conditions of those other website and platforms so you can understand how they operate. The inclusion of any link does not imply any endorsement of any website or platform by us. Any link within the GBBO App which takes you to a third-party website or platform is clicked on entirely at your own risk. We do not endorse or in any way adopt representations made by advertisers on any linked website or platform.

4. Submission of Material to the GBBO App

The following section of the Terms and Conditions applies to the submission by you of any Material to the GBBO App, in whatever form:-

4.1       Ownership of Material. You will retain copyright in any Material but we shall be entitled to use the Material in accordance with the Rights granted hereunder without obtaining further permission or making any payment to you. We may remove any Material if we are aware of or are alerted to or suspect that any Material is offensive, inappropriate, untrue or defamatory, a breach of copyright or any other proprietary right(s) or is a breach of any of the warranties and undertakings contained in these Terms and Conditions without prejudice to any other rights or remedies we may have.

4.2       You agree to provide true and accurate information about yourself as prompted by the GBBO App when submitting Material to it and as otherwise requested by us. To assist us in ensuring your personal information is up to date, please let us know if any of your personal details change by emailing us at [email protected].

4.3       By submitting any Material to the GBBO App, you grant to us the right to display the Material on the GBBO App and to edit, modify, adapt, translate, exhibit, publish, transmit, reproduce, copy, create derivative works from, distribute, perform, display and otherwise use such Material at no charge and in any medium for all purposes (including for example in any Programme, in other online media or in any Programme-related print publication) in any territory throughout the world for the full period of copyright and thereafter insofar as possible in perpetuity and for such purpose you agree to waive irrevocably all moral rights of whatever nature in the Material. The rights granted by you under this section of the Terms and Conditions are collectively hereinafter referred to as the “Rights”.

4.4      Upon submitting Material to the GBBO App you warrant and undertake that the Material you provide:

a) is genuine and accurate and original to you, has not been copied or reproduced from any published source, tangible or electronic and does not infringe the copyright or any other right of any third party;

b) is not defamatory, blasphemous, obscene, abusive, threatening, harassing or in contempt of court, and does not breach any contract, duty of confidence or right of privacy;

c) will not include any advertisements or promotions (including without limitation any business or business interests of your own or of any individuals, companies and/or organisations associated with you); and/or

d) be calculated to bring us and/or the Programme into disrepute.

4.5      You further warrant and undertake that you are fully entitled to grant the Rights to us and for such purpose you have obtained permission from any persons featuring, appearing or holding any proprietary, moral or intellectual property right in the Material (or any of its constituent elements).

4.6       If you have submitted any Material via the GBBO App and such Material is used by us in accordance with the Rights granted under these Terms and Conditions, we may retain such Material (and any connected personal information about you) for as long as is necessary in consideration of such use (e.g. in order to produce, market, distribute, exhibit, exploit, publicise, promote and/or advertise the Programme incorporating any of the Material and to comply with our obligations to any broadcaster or distributor or other licensee authorised to do the same in relation to such Programme).

4.7      You acknowledge that in using the Material in accordance with these Terms and Conditions, we may (but are not obliged to) identify you and accord you a credit, using your name (as given when submitting the Material) and place or origin.

4.8      You may copy material from the GBBO App, whether the material is our content or has been submitted by third parties and posted on the GBBO App, manually or electronically but only for your personal use. You may not sell or charge for access for any such material either singly or in collections. You may share a reasonable amount of such material in email or on other websites as long as credit is given (as applicable) to us or the author and a link (either clickable or text) to the material on the GBBO App. You may not otherwise copy, reproduce, republish, download, post, store (including in any other website), distribute, transmit, broadcast, commercially exploit or modify in any way any of the GBBO App’s material or content, remove any copyright, trademark or other proprietary rights notices from the GBBO App or materials originating from the GBBO App, frame or mirror any part of the GBBO App without our express prior written consent or permit or assist any third party to do the same.

5. Indemnity

We accept no responsibility for your actions or omissions, and you agree by accessing and/or using the GBBO App to indemnify and hold harmless us, our employees, officers, agents and contractors from and against all actions, proceedings, suits, claims, demands and costs (on a full indemnity basis) brought or made against us by any person arising from or in consequence of such actions or omissions or from breach by you of any of these Terms and Conditions, and from and against any damage, loss, cost or expense suffered or incurred by us as a direct or indirect consequence thereof, including in relation to any Material you contribute to the GBBO App. You agree that we may notify and/or co-operate with any authorities and law enforcement agencies in relation to any of your activities in relation to the GBBO App, including providing any and all information held by us, including your personal or other details, to those authorities and law enforcement agencies.

6. Terms of Service

6.1       The GBBO App offers access to content belonging to or under licence to Love and to content of other users. The GBBO App is provided free of charge. Love reserves the right to provide extended functions and additional services via in-app purchasing options.

6.2    We make no warranty on the availability of the GBBO App or its content. We and our subcontractors do not accept any responsibility whatsoever for any technical failure, malfunction of or any other problem with any computer network, system, server, provider, telephony system or otherwise which may result in the GBBO App being unavailable for use and/or unable to accept personal information and/or Material. We may, at any time, restrict access to users on an individual or group basis if we deem (at our sole discretion) there to be inappropriate use of the GBBO App. Under no circumstances may you attempt to auto-download, or mass-download, content from the GBBO App. We may, at any time, restrict access to users if we deem (at our sole discretion) there to be inappropriate use of the GBBO App.

6.3       Under no circumstances may you attempt to auto-download, or mass-download, content from the GBBO App. Using software that attempts to connect to the GBBO App and copy large amounts of data is prohibited. You agree that you will not attempt to, or assist any other person to, remove, circumvent or otherwise alter or interfere with our security technology and/or do anything that may damage or impair the GBBO App or our services, systems or equipment or those of third parties, including through the use of malicious code, bugs or viruses.

6.4       The GBBO App and its contents are the property of Love except where certain rights are stated as being limited or qualified and are attributed to other parties or persons. The foregoing does not apply to Material which is the subject of section 3 above.

8. Monitoring

Due to the large amounts of user-generated content we anticipate will be posted on the GBBO App, we will not be able to check all content but we reserve the right to block, change or delete content in response to complaints. However we periodically monitor traffic on the GBBO App and suspicious or malicious or excessive activity may be blocked and reported.

We may monitor and record any communications we receive from you. This may be done to improve the services which we provide or to ensure compliance with our practices and procedures.

9. Assignment

We can transfer our rights and obligations under these Terms and Conditions to any third party provided this does not affect your rights under these Terms and Conditions.

10. Miscellaneous

If we decide not to exercise or enforce any right that we have against you at a particular time, then this does not prevent us from later deciding to exercise or enforce that right. If any part of these Terms and Conditions is found to be illegal, invalid or otherwise unenforceable by a court or regulator, then, where required, that part shall be deleted and the remaining parts of the Terms and Conditions will continue to be enforceable. These Terms and Conditions do not create or infer any rights that are enforceable by any person who is not party to them.

11. Jurisdiction

These terms and Conditions will be exclusively governed by and construed in accordance with the laws of England and will be subject to the exclusive jurisdiction of the English courts.
